Contentious Probate & Inheritance Claims

  • Contentious probate refers to disputes regarding an Estate after an individual has died. This could be in relation to questions over the deceased not having had capacity to make their Will, allegations of forgery, coercion or difficulties with those administering the Estate.
  • Inheritance Claims are where an individual, usually a family member, has not been adequately provided for in the Will of the deceased or by the rules of intestacy.

When someone, particularly a loved one, has died it is often a very difficult time. This is intensified if there are questions over the Will or whether sufficient provision has been made for family members.

Such disputes can be complex and there can be short time limits for bringing claims to Court. It is therefore important to seek specialist advice early. At Waller Needham & Green we have significant experience dealing with claims including those involving large Estates in excess of £1m, disputes involving trusts and regarding allegations of coercion and undue influence.

Probate and Inheritance disputes need not mean lengthy and expensive Court proceedings which can cause lasting damage to family relationships. We will aim to negotiate a favourable settlement where possible and have experience of using Mediation and Alternative Dispute Resolution (ADR) to successfully settle cases.
